Terms of Service

These Terms of Service govern access to and use of push-mail, including its website, messaging features, public profile features, upload features, and notification features.

By accessing or using push-mail, you agree to these terms. If you do not agree, do not use the service. If you use the service on behalf of an organization or another person, you represent that you have authority to do so.

1. Eligibility And Acceptable Access

  • You may use push-mail only in compliance with applicable law and these terms.
  • You are responsible for ensuring that your use of the service is permitted in your jurisdiction and appropriate for your intended purpose.

  • push-mail may provide messaging, public profile, contact, and notification tools, but does not guarantee delivery, timing, availability, confidentiality against all risk, or compatibility with every browser, device, or push provider.
  • Notification delivery depends on browsers, operating systems, device settings, background permissions, network conditions, and third-party push infrastructure.
  • You are solely responsible for deciding what information you publish on any public profile or send through the service.

5. Files And Storage

  • Uploaded files, messages, and related data may be stored and processed as needed to operate the service, enforce limits, moderate abuse, investigate incidents, and maintain technical functionality.
  • You must not use the service as a guaranteed archival, backup, escrow, or records-retention system.
  • You remain responsible for keeping independent copies of any data you consider important.

6. Prohibited Use

  • Accounts, usernames, messages, files, or access may be limited, suspended, or terminated at any time if use appears to violate these terms, create risk, or threaten the service or others.

8. Third-Party Services

  • The service may rely on third-party browsers, networks, hosting environments, identity providers, push services, or other infrastructure.
  • Third-party services are governed by their own terms and privacy practices. push-mail is not responsible for third-party systems, downtime, content, or policies.

9. Intellectual Property

  • Except for user content and third-party content, the service, its software, design, and related materials remain protected by applicable intellectual property and other laws.
  • These terms grant only a limited, revocable, non-exclusive, non-transferable right to use the service as made available by push-mail.
  • No ownership or broader license is transferred unless expressly stated in writing.

  • push-mail disclaims warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, accuracy, and uninterrupted operation.
  • push-mail does not warrant that the service will meet your requirements, that communications or files will always be delivered or preserved, or that the service will be free from loss, interception, corruption, delay, or vulnerability.

12. Limitation Of Liability

  • To the fullest extent permitted by applicable law, push-mail and its operator, contributors, suppliers, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, goodwill, data, use, business opportunity, or reputation, arising out of or relating to the service or these terms.
  • To the fullest extent permitted by applicable law, any aggregate liability arising out of or relating to the service or these terms will be limited to the greater of the amount you paid, if any, to use the service during the twelve months before the claim arose, or one euro.
  • Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnity

  • To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless push-mail and its operator, contributors, suppliers, service providers, and affiliates from claims, liabilities, damages, judgments, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the service, your content, your communications, or your violation of these terms or applicable law.

14. Termination

  • You may stop using the service at any time.
  • push-mail may suspend or terminate access, delete or disable content, and take technical or legal measures where reasonably necessary to enforce these terms, protect the service, or comply with law.
  • Sections that by their nature should survive termination will survive, including sections on liability, disclaimers, indemnity, intellectual property, enforcement, and dispute-related provisions.

15. Governing Law And Disputes

  • These terms are governed by the mandatory law applicable to the operator and the use of the service, without preventing the application of consumer protections or other non-waivable rights that apply under law.
  • Any dispute, claim, or controversy relating to the service or these terms will be handled in the legally competent forum unless applicable law requires otherwise.

  • A failure to enforce any provision is not a waiver of any right or remedy.
